Terms of Service:

• One item per registered guest.
• The work carried out in the Repair Café is free of charge and done on a voluntary basis by the fixers at hand.
• Fixers will help visitors to learn the repair process on items brought in. To the extent possible, fixers will help visitors do the repair themselves, or fixer and visitor will conduct the repair together, or the fixer will demonstrate the repair process to the visitor.
• Visitors offering broken items for repair do so at their own risk. Experts making repairs offer no guarantee for the repairs carried out with their help and are not liable if objects that are repaired in the Repair Café turn out not to work properly at home.
• Fixers are entitled to refuse to repair certain objects at their own discretion, including items that contain asbestos insulation (manufactured before 1994) or lead, unclean items containing food residue, items containing insects of any kind (dead or alive), and/or dirty or unwashed clothing.
• Fixers are not obliged to reassemble disassembled appliances that cannot be repaired.
• Visitors to the Repair Café are solely responsible for their items at all times, and for the tidy removal of broken objects that could not be repaired.
• New parts or materials required for a repair shall be provided by the visitor.
• All Safety Procedures and Hamilton Public Library policies must be followed.

Safety Procedures:

• All electrical items must be unplugged while being disassembled.
• All heating devices must be thoroughly cleaned before powering on (e.g. space heaters, toasters, hair dryers).
• When using test equipment, clip-on leads must be used to ensure non-contact when item is powered on.
• When testing a disassembled item, a power bar must be used to turn power off and on.
• When using sharp tools or power tools, appropriate personal protective equipment must be used, such as eye and hand protection.
• Workspace should be kept tidy and hazard-free. Food and drink should not be consumed during repair activities.
• The year of manufacture of heating products must be checked with visitors. Such items made before 1994 must not be opened at the Repair Café.
• No built-in safety features (e.g. fuses, safety switches) will be bypassed.

Indemnity and Waiver:
The Registrant hereby covenants and agrees to indemnify, defend, and save harmless the Hamilton Public Library, its officers, directors, employees, servants, agents, contractors, and their respective heirs, executors, administrators, successors, and assigns, from and against any and all losses, claims, actions, expenses, costs, demands, suits, liabilities or damages of every nature and kind whatsoever including death or injury, costs or expenses (including but not limited to legal fees, disbursements and taxes on a solicitor-client basis) that the Library may sustain, incur, suffer or be put to at any time before, during, or after the Repair Café, arising out of or occurring directly or indirectly from the Registrant’s participation in the Repair Café. The Hamilton Public Library will not be responsible for any injuries sustained by the Registrant, or damage to their personal property as a result of their participation in the Repair Café.

Photo/Video Waiver:
The Registrant acknowledges that the Library may take photos and audio and/or visual records may be made during the course of the Repair Café. The Registrant irrevocably agrees that the Library, its successors, assigns and licensees may use these photographs/ videos, if so desired, in any and all media of any nature whatsoever, whether now known or hereafter devised, for the purpose of promoting and advertising the Library and its programs, without the payment of compensation. The Registrant acknowledges and agrees that the Library shall own all rights to all photographs/ videos of the Registrant made by it, its employees and representatives, at any time or times before or after the event.

Personal Information:
Personal information contained on this form is collected under the authority of the Freedom of Information and Protection of Privacy Act, 1990. MFIPPA\Regulations 29. The information collected will be used in the process of the library’s business. Electronic Signature:
By checking the "Agree" box, the Registrant is signing this Registration Form electronically. The Registrant agrees their electronic signature is the legal equivalent of their manual signature on this Registration Form. The Registrant consents to be legally bound by this Registration Form's Terms of Service, Safety Procedures, Photo/Video Waiver, and Indemnity and Waiver. The Registrant further agrees that their use of a keypad, mouse or other device to select an item, button, icon or similar act/action, or to otherwise provide the Library instructions, or in accessing or making any transaction regarding any agreement, acknowledgement, consent terms, disclosures or conditions constitutes their signature (hereafter referred to as "E-Signature"), acceptance and agreement as if actually signed by the Registrant in writing. The Registrant also agrees that no certification authority or other third-party verification is necessary to validate their E-Signature and that the lack of such certification or third party verification will not in any way affect the validity and enforceability of their E-Signature or any resulting contract between the Registrant and the Library.

The Registrant acknowledges that they are at is least eighteen (18) years of age and have CAREFULLY READ, UNDERSTOOD, AND WILL ABIDE by the Terms of Service, Safety Procedures, Photo/Video Waiver, and the Indemnity and Waiver.
